Don't we have to deputize all of our troops now?

If prisoners of war are getting trials in US criminal courts, we have a serious problem here.

The reality of it is that we as a country said that torture was wrong when we wrote it into the Geneva Conventions. The United States of America is a civilized nation. Only criminals use torture. If you want to live in a country that condones the use of torture then move.
