Thanks Chief! Most of the dumb SOB's that put Obama in will be on the soup line in 4 years. Too bad it will be too late to learn from their mistake.

I think the moves are pretty cunning by the obama admin.
If the bonus's are taxed away or taken in court its a weakening of the constitution rights of americans.
This has been the goal of the aclu sense its revival of the 60s and obama will be able to do it with popular support.
The constitution protects citizens from government and can get in the way of an overly aggressive agenda.

If it holds, it will set a precedent - being able to punish individuals by disproportionate taxation. It violates the constitution's separation of powers.

I just saw David Bois (Gore vs. Bush 2000) on TV, saying if this legislation is targeting a small group, using taxation as a punishment after the fact, of a non-crime without a trial, then it is a Bill of Attainder and is unconstitutional.

Bill of attainder

A bill of attainder (also known as an act or writ of attainder) is an act of legislature declaring a person or group of persons guilty of some crime and punishing them without benefit of a trial. Bills of attainder are forbidden by Article I, section 9, clause 3 of the United States Constitution.

If it passes and gets signed into law by Obama, then it will become a major court case.

What a great distraction for the media to run with, from the economy busting 2009 Budget and pork-filled Stimulus Bill.

This is exactly why I see this admin as cunning.
Sure this could end up in court and maybe will.
But the popular president is whipping his lemmings into a fever and those due bonuses may just give up.
Either way hes encreased his scope and deminishing that pesky constitution.
This should have been addressed before bailouts, but these guys know how to turn a fuck up into lemonade.
