Surprise! The supremes sided with business against the consumer and the middle class again.

WASHINGTON -- The Supreme Court gave business two big wins Wednesday by shielding companies from lawsuits and state regulations.
In one ruling, the court said makers of medical devices, such as heart valves and pacemakers, cannot be sued by injured patients if the Food and Drug Administration had approved the devices for sale.
Oh yeah, they also struck down states rights. Suck this, old time conservatives - states don't have the rights they used to have, they must now suck federal dick.
But in a 9-0 ruling, the court said a federal law deregulating the trucking industry swept aside all such state rules, even those designed to protect health and safety.
"You can't have 50 states setting different rules for shipping services. It would result in higher costs and slower service," said Washington lawyer Beth S. Brinkmann, who represented the shipping industry.
In both decisions, the court read federal law broadly to protect companies from juries and state regulators.

State's rights have been long dead. That's the way people want it. The people want the entire country to be forced to think as they do, not just the state they live in. You have to remember programs like the FDA are only disguised as consumer protection. Their true purpose is to serve their corporate masters. When you ask for big government you msut take the bad with the good. The bad will always outweigh the good, but its well worth it to the people if it alleviates them of any responibility. The FDA shouldn't be making these decision, we should. However that takes effort and people would rather trust government to do it, even if it means they don't do a good job. Yet another great example of how much the American people hate freedom.

The FDA which the irresponsible congress has farmed out to Pharmaceuticals now gets a thumbs up or down on reckless procedures done to you by more profiteering medical companies.
Let's see,
the FDA is funded by Drug companies,
but they would never let shoddy or dangerous medical devices or drugs on the market for you to use, would they?
Where is Upton Sinclare when we need him?

Yep, we have to get our responsibilities back from government. We voted them over to the politcians who sold them out to the highest bidder.

in the end i guess we have to be our own first line of defense against all the untrustworthy people we deal with.
Although if you can create a relatively clean market it does make a cheaper more efficient place to do business.
Unfortunately I agree with both rulings.
1. The drug companies shouldn't be sued if the government claims a product is safe. That would be silly like smokers suing the tobacco companies. Oh, wait a minute.
Unfortunately massive law suits are not the answer. If everyone says that a drug is OK then the companies making it should be safe. However, we might need a better process to decide if something is safe or not.
With drugs we have the problem of some needed drugs being tied up in the regulation process for years when those same drugs are saving lives in Europe. We also have the problem of such massive profits for drugs in the USA that people will gladly bribe and knowingly kill others for the massive gains.
Something needs to change and it seems that it's the profits end.
2. Federal law always out weighs state law just as state law out weighs county and city law.

And you are right, the 10th amendment no longer applies, federal government has supreme power.

Kres you make some very good points about governments involment in our lifes and I too believe we have given our powers away...My question to you is how do we take back the government so it works for all the people...if you have a plan, how would you get the masses involved...how would we move forward...how do you overcome the complatency in America today???? I would appreciate your thoughts...if you have a plan, let us hear it.....

Vote for politcians who will eliminate these programs. It will be tough living for a while for many bit in the long run its the only way to save ourselves. If you are voting for Reps and Dems and expecting change you are wasting your vote. If you are re-electing the same crap politcians over and over again, you are wasting your vote.
Sadly we have gone so far in turning our lives over to government it will be an uneasy transition back to self responsibility. It's a transition that hast to take place soon to save this country though.

I don't vote on party lines...I vote for the person I think will make the best decisions for us ..sadly most americans vote along party lines and simply refuse to look at it any other way. So yes, it looks like we're screwed!!!

It's not profits that are bad. It's profits generated by government regulations that I think is bad. Since our government regulates that we can't buy drugs from countries like Canada but allows drug distributors to buy from China is regulating for profits while being harmful to Americans.

I completely agree there, but regulation is what the people want. Regulation is a politician's best friend. Create less competition for your corporate buddies, look like a consumer hero to the ignorant and lazy masses.
