Murtha must testify in defamation case

WASHINGTON - A federal judge refused Friday to dismiss a defamation case against Rep. John P. Murtha and ordered the Pennsylvania Democrat to give a sworn deposition about his comments alleging "cold-blooded murder and war crimes" by unnamed soldiers in connection with Iraqi civilian deaths.
A Marine Corps sergeant is suing the 18-term congressman for making the charge, which the soldier claims is false. Murtha, who opposes the Iraq war, made the comment during a May, 2006 Capitol Hill news conference in which he predicted that a Pentagon war crimes investigation will show Marines killed dozens of innocent Iraqi civilians in Haditha in 2005.
Murtha's office declined to comment on the ruling. A Vietnam veteran and retired Marine Reserves colonel, Murtha has said his intention was to draw attention to the pressure put on troops in Iraq and efforts to cover-up the incident.
The Justice Department wanted the case dismissed because Murtha was acting in his official role as a lawmaker. Assistant U.S. Attorney John F. Henault said the comments were made as part of the debate over the war in Iraq.
U.S. District Judge Rosemary M. Collyer said the congressman might be right, but said she won't know for sure unless Murtha explains himself. She did not set a date for Murtha's testimony but said she would also require him to turn over documents related to his comments.
"You're writing a very wide road for members of Congress to go to their home districts and say anything they choose about private persons and be able to do so without any liability. Are you sure you want to do that?" Collyer said, adding later, "How far can a congressman go and still be protected?"
Collyer said she was troubled by the idea the lawmakers are immune from lawsuits regardless of what they say to advance their political careers.
Mark S. Zaid, the attorney for the plaintiff, Marine Staff Sgt. Frank Wuterich, said he wanted Murtha's deposition and limited documents from the congressman, including calendars and documents related to which reporters he spoke to.
Zaid said Murtha was not acting within his congressional duties and was instead trying to embarrass then-Secretary of Defense Donald Rumsfeld, with whom Zaid said Murtha had a personal dispute.
Collyer, who was appointed to the bench by President Bush, said the case wasn't about whether to recall troops from Iraq and she didn't "particularly care" about Murtha's views on the war. She said the law cares only about what Murtha intended when he made the comments.
Charges have been dismissed against four of the eight Marines who were initially charged with murder or failure to investigate the deaths in Haditha. A battalion commander has been recommended for a court-martial; a final decision is pending.
The investigating officer overseeing the Haditha case is expected to recommend soon whether Wuterich should stand trial. Wuterich, 27, of Meriden, Conn., is accused of unpremeditated murder in 17 of the killings.

Considered against recent cases, including soldiers from the 101st Airborne Division convicted of killing detainees in Samarra, Iraq, last year and the ongoing courts-martial of Marines accused of killing 24 civilians in Haditha, these new examples shed light on the frequency soldiers and Marines may disregard the rules of war.
Nasrina Bargzie, an attorney with the ACLU's National Security Project, said the documents also show that theres an abundance of information being withheld from public scrutiny.
"The government has gone out of its way to hide the human cost of this war," Bargzie said. Releasing the documents now "paints at least a part of that picture so people at least know what's going on," she said.
The lawsuit seeks to compel the military to produce all documents related to all incidents of civilian deaths at the hands of U.S. troops in Iraq and Afghanistan since January 2005. The ACLU contends the materials are releasable under federal law.
The Defense Department declined to comment on the lawsuit until it could review its claims.
Among the files released to the ACLU were the court-martial records for two soldiers convicted of assault in the drowning of a man pushed into the Tigris for violating curfew and three soldiers convicted in the "mercy killing" of an injured teenager in Sadr City.
The teen had been severely injured; one soldier explained that he shot and killed the teen "to take him out of his misery."
Other killings included:
_ A man shot after a search of his home near Balad uncovered illegal weapons and anti-American literature. Immediately after the shooting, according to testimony, Sgt. 1st Class George Diaz, who was convicted of unpremeditated murder, said, "I'm going to hell for this." Diaz also was convicted of mistreating a teenage detainee when he forced the youth to hold a smoke grenade with the pin pulled as Diaz questioned him at gunpoint.
_ A suspected insurgent in Iraq by Staff Sgt. Shane Werst, who said the man appeared to be reaching for a weapon. Werst was acquitted of murder despite acknowledging he had fired and then planted a chrome Iraqi pistol on the suspect to make his claim of self defense more believable.
In a previously unreported case, Pfc. James Combs was convicted of involuntary manslaughter for shooting an Iraqi woman from a guard tower in what he claimed was an accident, though court documents and testimony indicate his weapon was set to fire multiple shots despite a regulation advising against such a setting.
Another previously undisclosed case involved Sgt. Ricky Burke, who was charged with murder for killing a wounded man alongside the road following a firefight. Staff Sgt. Timothy Nein, a member of Burke's military police company, testified he heard Burke say before the shooting, "It's payback time."
Burke, a member of the Kentucky National Guard, was found not guilty of the charges that stemmed from the same battle that led to the first woman since World War II being awarded the Silver Star.
In closing arguments, Burke's attorneys asked the jury to recommend that soldiers be trained better for handling detainees. "They are not trained to standard," said an attorney not identified in the transcript.
The attorneys also insisted that the rules of engagement are clear and in favor of soldiers, contending that the perception of hostility merits deadly action.
Michael Pheneger, a retired Army intelligence colonel who reviewed the materials for the ACLU, said the documents suggest many allegations of war crimes in Iraq are not being made public.
"Wars are messy by their very nature. These are dangerous circumstances, and the fog of war is out there," said Pheneger, who served in Vietnam. "But it's perfectly obvious that there is no rule of engagement that would authorize someone to kill someone in custody."

can us conservatives comment on it as well? I think it is appropriate for Murtha to give testimony about it - and I really hope that they allow it to be public as I cant wait to see what he says, as he is about to expose the real story of what happens in a real war to the many Americans sitting around at home who have no idea what kind of pressure a soldier is under and what can happen when they are not trained to handle civilian encounters in a ground war
I have a feeling though that they may make it a private show, as they may be afraid that it would unduly influence the military case agains tthe soldier that is charged with responsibility in the 17 civilian deaths and hasnt gone to military court yet
I do believe that Murtha is a bit nutty and it's nice to see him shut up. However, this is interesting. In the past anyone on the floor could say anything that wanted and it was always exempt from slander or anything else.

I think he has a specific reason for doing all of this - and Im pretty sure it will come to light and backfire on those idiots blabbering on the right wing mainstream news media - he spent enough time in Vietnam to know what really happens in war - and unfortunately for all of the talking "heads" they havent - and dont know what they are in for - I totally believe that Murtha (as much as he has been emphasizing this) is setting them up quite well

This topic isn't a real priority with me, the outcome is already obvious.
I don't agree with his statements and I think he's wrong but this one case could change the way that politicians work forever. Almost every politician in office over the past 2 decades could find themselves in Murtha's shoes.
That's why it should be such a great trial.
